You say we’re supposed to preserve documents — does that cover trustees’ personal email and text messages about township business?

Yes! If you are using personal email and sending text messages from your personal phone to conduct township business, that data must be preserved because it is a public record. Not only are personal emails and text messages about township business public records that are subject to FOIA, but if you delete that information during litigation, you could be sanctioned by the Court. The best practice here is to avoid conducting township business with personal cell phones and email addresses.
