Plat Revisions

Recorded subdivision plats continue to shape how property may be used, developed, and transferred long after a subdivision is first created. In many Michigan communities, especially older subdivisions and lake areas, the plat on file may no longer contain an accurate representation of modern subdivision. Roads shown on the plat may never have been built or have been built in a different location, platted easements may interfere with construction or use of property, and historic lot layouts may no longer support current use or access needs.

Fahey Schultz Burzych Rhodes can advise property owners, businesses, developers, and municipalities throughout Michigan on subdivision plat revisions and related land use issues. Our attorneys help clients evaluate existing plat features under the Michigan Land Division Act, determine whether a formal revision is needed, and address the legal and property interests involved.

When a Plat Revision May Be Needed

A recorded plat creates a map of a platted subdivision that establishes lot lines and identifies roads, easements, and other shared features. Because plats exist in perpetuity, they can continue to affect property rights even when conditions on the ground have changed. A formal revision may be needed when a platted feature interferes with the property’s current use or future plans for development.

Our plat revision experience includes:

  • Vacating unbuilt or “paper" roads and other access features shown on the plat
  • Evaluating easements that interfere with development or access
  • Resolving boundary and title concerns tied to historic subdivision layouts
  • Clarifying rights involving platted common areas, including beaches and lake-access points
Plat Revision Counsel for Property Owners, Businesses and Developers

Plat issues often come to light during a survey or title review. A single recorded feature can create title concerns, limit access, or delay plans that otherwise appear ready to move forward.

Our attorneys can assist property owners and developers with:

  • Evaluating how a platted feature may affect a project or property transaction
  • Identifying the appropriate process for revising a subdivision plat
  • Coordinating with surveyors and other project consultants
  • Communicating with neighboring property owners and local officials when needed
  • Participating in court proceedings to amend or vacate a platted feature under Michigan’s Land Division Act
Plat Revision Counsel for Municipalities & Local Government

Municipalities and other local government officials like drain commissioners are served in plat revision actions on a regular basis and may have a direct interest in plat revisions affecting public access, infrastructure, easements or other municipal interests.

Our attorneys assist municipalities with:

  • Reviewing proposed subdivision plat revisions under the Michigan Land Division Act
  • Evaluating effects on public access, infrastructure, easements, and planning
  • Preparing for or responding to court proceedings involving subdivision plats
Dedicated to serving your legal needs.

Revising a subdivision plat is rarely a simple administrative fix. Contact us to discuss the legal requirements involved and whether a formal revision may be appropriate.
